1. General
1.1. These terms govern your use of the Pivotal Network website, any content (such as text, data, information, software, graphics or photographs) that Pivotal may make available through the Pivotal Network website (collectively, "Pivotal Network Materials") and any services that Pivotal may provide through the website (collectively, " Pivotal Network Services"). The Pivotal Network website, Pivotal Network Materials, and Pivotal Network Services are referred to in these terms collectively as "Pivotal Network." By accessing files, browsing or using this Pivotal Network website, you agree to comply with both these terms of use and the Terms of Use posted at https://pivotal.io/terms-of-use , as may be updated by Pivotal from time to time (“ Terms of Use”), which are incorporated herein by reference. Unless otherwise indicated, capitalized terms have the meaning stated in the Terms of Use.
2. Use of Pivotal Network
2.1. You agree that you will not use any false, inaccurate or misleading information when registering and promise that the information you provide to Pivotal is true, complete and accurate. You are responsible for all account activity. Pivotal may deny you access if your account is out of compliance with the Terms of Use, these terms of use, or any other regulatory requirements. You may not use Pivotal Network for any purpose that:
2.1.1. is unlawful or prohibited by these terms or the Terms of Use;
2.1.2. solicits the performance of any illegal activity or other activity which infringes the rights of Pivotal or others;
2.1.3. includes defamatory, obscene, infringing or other unlawful material or information;
2.1.4. would allow participants or third parties to harm other users' computers or to inappropriately access data, software or websites, or to interfere or attempt to interfere with the proper working of Pivotal Network, any transaction being conducted on Pivotal Network, or with any other person's use of Pivotal Network; or
2.1.5. attempts to gain unauthorized access to any portion or feature of Pivotal Network, any other systems or networks connected to Pivotal Network or to any Pivotal server, or any of the services offered on or through, by hacking, password "mining" or any other illegitimate means.
2.2. If you are a admin of a Pivotal Network account (or a user delegated such authority by an admin), you agree to monitor and maintain all account user access granted by you to ensure that all users on your account are authorized, act according to permissions granted, and comply with all applicable laws, ordinances, statutes and regulations, including but not limited to privacy and security of personal information and all content and data made available under these terms.
3. Data Sharing Notice
3.1. By signing up for a Pivotal Network account, you agree to the following: (a) if you are a corporate customer, you acknowledge that your corporate contact or organizational information, including, without limitation, name and email address, will be displayed and visible to others within your Pivotal Network account, and (b) if you are a consumer, you acknowledge that your name, email address and other contact details will be displayed and visible to others within your Pivotal Network account. You or your Pivotal Network account admin have supplied this information to Pivotal either as part of evaluating or purchasing Pivotal Software or Services or in connection with the Pivotal Network site. You acknowledge that Pivotal will process such information in connection with the Pivotal Network. You will remain responsible for ensuring that the information you place into Pivotal Network is collected and transferred to Pivotal in accordance with applicable laws.
4. Risk of Unintended Access to Your Data
4.1. It is very important that you carefully follow the instructions provided within the screen text and review your Pivotal Network settings and permissions. You understand and agree that if you allow access to someone you did not intend or fail to update your account to remove expired users, you could cause your confidential information to be disclosed to unintended third parties.
4.2. Data contained in this system has been extracted from internal Pivotal sources, including ordering, licensing and support systems. While care has been used to ensure accuracy, it is possible that errors have occurred.
5. Member Account, Password and Security
5.1. You will receive a password and account designation upon completing the Pivotal Network registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account, including as a result of your failure to keep this information secure and confidential. You will (1) immediately notify Pivotal of any unauthorized use of your password or account or any other breach of security, and (2) ensure that you exit from your account at the end of each session. Pivotal cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
6. Violation of These Terms
6.1. Pivotal may, in its sole discretion and without prior notice, terminate your access to Pivotal Network and/or block your future access to Pivotal Network if we determine that you have violated these terms or any other agreement between you and Pivotal.
